I have been falsely accused of domestic abuse by my wife. I never laid a hand on her but now I can’t get near our home. Can I fight this?

Absolutely. Domestic matters are very difficult because they often involve a “He said/She Said” type situation. Often, there is no other evidence other than the complaining witness’ testimony. Sometimes there are considerations of a spousal privilege or 5th amendment issue (if the other party participated in criminal behavior). Often there is investigation of evidence or witnesses required. It is important to have an attorney on your side to look at the allegation and examine the evidence, while considering proof of the elements necessary to find you guilty. An attorney will assess the strength of the case, determine whether the Commonwealth has sufficient evidence and/or negotiate potential resolution of the case in advance of a trial.
